Terms and Conditions of Use

Please read these Terms and Conditions carefully before using My Mental Gym application or website. By creating an account or accessing the Platform in any way, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MY MENTAL GYM LLC ("Company," "we," "us," or "our") governing your access to and use of the MY MENTAL GYM LLC mobile application and website (collectively, the "Platform").

By accessing or using the Platform, creating an account, downloading the application, or clicking "I Agree," you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

If you are under 18 years of age, you represent that you have the permission of a parent or legal guardian to use the Platform and that your parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Description of the Platform

MY MENTAL GYM LLC is a structured mental performance training application built on applied sport psychology principles. The Platform delivers a progressive two-year daily training program organized across four levels. The program includes daily mental training drills, written journal prompts, and educational content drawn from evidence-based sport psychology research.

The Platform is designed to help competitive athletes develop psychological skills including attentional control, self-talk management, visualization, emotional regulation, resilience, goal-setting, and team cohesion. These are performance enhancement skills used widely in applied sport psychology and athletic development contexts.

The Platform is not a clinical service. The content is educational and training-oriented in nature. Using the Platform is more similar to working with an athletic performance coach on mental skills development than to receiving clinical psychological treatment.

3. Not a Medical or Psychological Service

Section 3 contains the most important information in these Terms. Please read it carefully.

3.1 Training Tool Only

My Mental Gym is exclusively a mental performance training tool. All content, drills, journal prompts, educational materials, and guidance provided through the Platform are intended solely to support the development of mental performance skills in healthy, competitive athletes. The Platform is not intended to, and does not, provide any form of:

• Psychological assessment, diagnosis, or evaluation
• Clinical mental health treatment or therapy
• Psychiatric care or medication guidance
• Crisis intervention or emergency mental health support
• Counseling for mental health disorders, trauma, or emotional disturbances
• Any professional service that constitutes the practice of psychology under applicable law

3.2 No Professional-Client Relationship

Use of the Platform does not create a therapist-patient relationship, a counselor-client relationship, a psychologist-client relationship, a physician-patient relationship, or any other professional-client relationship of any kind. The Company is not your mental health provider, counselor, therapist, or physician.

3.3 No Diagnosis

The Platform does not and cannot diagnose any psychological disorder, mental health condition, learning disability, personality disorder, or any other condition. The self-assessment exercises and reflection activities in the Platform are performance development tools. They are not clinical assessments and should not be interpreted as indicators of the presence or absence of any psychological condition.

If you have concerns about your mental health or believe you may be experiencing symptoms of a psychological disorder, please consult a licensed mental health professional. The Platform is not an appropriate resource for evaluating or addressing mental health symptoms.

3.4 Content Is Educational, Not Clinical

The sport psychology concepts presented in the Platform are drawn from peer-reviewed research and established applied sport psychology practice. They are presented in an educational context to support athletic performance development. The effectiveness of mental performance training varies between individuals. The Platform makes no guarantee that any particular user will achieve any specific performance outcome by completing the program.

3.5 If You Are Struggling

If you are experiencing significant emotional distress, depression, anxiety, trauma responses, eating disorder symptoms, substance use concerns, or any other mental health challenges, please reach out to a qualified mental health professional. These issues are beyond the scope of what the Platform can support and require professional care.

4. Eligibility

You must be at least 13 years of age to create an account and use the Platform. By creating an account, you represent and warrant that:

• You are at least 13 years of age
• If you are between 13 and 17, you have the permission of a parent or legal guardian who has reviewed and agreed to these Terms
• You have the legal capacity to enter into a binding agreement
• Your use of the Platform does not violate any applicable law or regulation

5. User Accounts

5.1 Account Creation

To access the full features of the Platform, you must create an account by providing accurate and complete information. You agree to keep your account information current and accurate.

5.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@mymentalgym.com if you become aware of any unauthorized access to your account. We are not responsible for losses resulting from unauthorized use of your account.

5.3 One Account Per User

Each user may maintain only one account. You may not create accounts on behalf of others without their knowledge and consent.

6. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Platform in any way that violates any applicable local, state, national, or international law or regulation
• Attempt to circumvent, disable, or otherwise interfere with the Platform's security features
• Attempt to gain unauthorized access to any portion of the Platform, other user accounts, or any systems or networks connected to the Platform
• Upload, transmit, or distribute any malicious code, viruses, or harmful software
• Use the Platform to harass, abuse, or harm any other person
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Platform
• Copy, reproduce, distribute, or create derivative works of the Platform's content without our express written permission
• Use the Platform for any commercial purpose without our prior written consent
• Misrepresent your identity or affiliation with any person or organization

7. Intellectual Property

7.1 Our Content

All content on the Platform — including but not limited to the program curriculum, weekly and daily drill content, journal prompts, educational materials, training frameworks, visual design, trademarks, logos, and software — is the exclusive property of MY MENTAL GYM LLC or its licensors and is protected by copyright, trademark, and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform content for your own personal, non-commercial use as a program participant. This license does not include any right to copy, reproduce, distribute, display, sell, or create derivative works from our content.

7.2 Your Content

You retain ownership of the journal entries and other content you submit through the Platform. By submitting content, you grant us a limited license to store and display that content to you within the Platform. We do not claim ownership of your journal entries or use them for any purpose beyond delivering the Platform's functionality to you.

7.3 Feedback

If you provide us with suggestions, feedback, or ideas about the Platform, you grant us a royalty-free, perpetual, irrevocable license to use, implement, and otherwise exploit that feedback without any obligation to you.

8. Third-Party Services

The Platform may integrate with or contain links to third-party services, websites, or content. We do not control and are not responsible for the content, privacy practices, or terms of any third-party service. Your use of any third-party service is governed by that service's own terms and privacy policy. We encourage you to review the terms of any third-party service before using it.

9. Modifications to the Platform

We reserve the right to modify, update, suspend, or discontinue the Platform or any part of it at any time with or without notice. We will make reasonable efforts to notify users of significant changes. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

We may update the program content to improve its quality, accuracy, or alignment with current sport psychology research. Program content updates do not constitute a material change to these Terms.

10. Fees and Payment

Certain features of the Platform may require payment of fees. If you choose to purchase a subscription or other paid feature, you agree to pay all applicable fees as described at the time of purchase. All fees are stated in US dollars unless otherwise indicated.

Subscription fees are billed on a recurring basis (monthly or annually, depending on the plan you select) until you cancel. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods unless required by applicable law.

Payment processing is handled by third-party payment processors. We do not store your full payment card information. Your payment information is subject to the terms and privacy policy of our payment processor.

11. Disclaimers and Limitations of Liability

11.1 Platform Provided "As Is"

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, completely secure, or free of viruses or other harmful components. We do not warrant that any defects will be corrected or that the Platform will meet your specific requirements or expectations.

11.2 No Guarantee of Results

Mental performance training outcomes vary significantly between individuals based on factors including but not limited to the consistency of practice, existing psychological skills, individual learning styles, sport context, and competitive circumstances. We make no representation or guarantee that completing the program will produce any specific athletic or psychological outcome.

11.3 Not a Substitute for Professional Care

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ANY LIABILITY ARISING FROM YOUR USE OF THE PLATFORM AS A SUBSTITUTE FOR PROFESSIONAL PSYCHOLOGICAL, MEDICAL, OR MENTAL HEALTH CARE. THE PLATFORM IS NOT DESIGNED TO IDENTIFY, ASSESS, TREAT, OR MANAGE ANY PSYCHOLOGICAL DISORDER OR MENTAL HEALTH CONDITION, AND WE ARE NOT RESPONSIBLE FOR ANY HARM THAT MAY RESULT FROM USING THE PLATFORM IN THAT MANNER.

11.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MY MENTAL GYM LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless MY MENTAL GYM LLC and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Platform, or any content you submit to the Platform.

13. Privacy

Our collection, use, and storage of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you agree to the terms of our Privacy Policy.

14. Termination

We may terminate or suspend your account and access to the Platform at any time, with or without cause and with or without notice, if we believe you have violated these Terms or if we determine that your account activity poses a risk to the Platform or other users.

You may terminate your account at any time by contacting us at support@mymentalgym.com or through the account deletion feature in the Platform settings. Upon termination, your right to access the Platform immediately ceases. Provisions of these Terms that by their nature should survive termination will survive, including disclaimers, limitations of liability, and dispute resolution provisions.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Platform shall first be addressed through good-faith informal negotiation. If informal negotiation does not resolve the dispute within 30 days, the parties agree to resolve the dispute through binding individual arbitration in accordance with the rules of the American Arbitration Association, rather than in court.

YOU AND MY MENTAL GYM LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If this class action waiver is found unenforceable, then the entire arbitration provision shall be null and void.

Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief in court to prevent irreparable harm pending arbitration.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform with a new effective date and, where appropriate, by sending you an email notification. Your continued use of the Platform after the updated Terms become effective constitutes your acceptance of the changes.

If you do not agree to the updated Terms, you must stop using the Platform. It is your responsibility to review these Terms periodically for changes.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MY MENTAL GYM LLC regarding your use of the Platform and supersede all prior agreements, representations, and understandings between you and us.

17.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
